TERMS AND CONDITIONS OF MEMBERSHIP 

 

(Early Access Unmanned Gym / All other facilities - Participant Agreement, Waiver, and Release of Liability) 

 

1. Participant Agreement, Waiver, and Release of Liability 

We care about the safety and wellbeing of all participants who use our facility. Canolfan Beaumaris has taken all necessary precautions to ensure the facilities are safe for use during both manned and unmanned hours. 

 

In consideration of being permitted to use Canolfan Beaumaris’ services, facilities, and/or equipment to participate in physical fitness activities, you agree to the following: 

 

1.1 Risks 

(a) You fully understand and acknowledge that risks and dangers exist in your use of gym equipment and participation in Canolfan Beaumaris activities. 

(b) Your participation in such activities and/or use of such equipment may result in serious injury, illness, heat stroke, heart attack, blindness, disability, or death. 

(c) These risks and dangers may be caused by your own actions or inactions, the actions or inactions of others, the condition of the equipment or premises, negligence, or other causes. 

(d) You voluntarily assume all such risks and take full responsibility for any losses, injuries, or damages arising from your participation or use of the facility and equipment. 

 

1.2 Release of Liability 

You, on behalf of yourself, your personal representatives, and your heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify Canolfan Beaumaris, its owners, directors, employees, agents, and representatives from any and all claims, demands, actions, or losses for bodily injury, property damage, wrongful death, or any other loss arising out of your use of the gym, equipment, or participation in Canolfan Beaumaris activities, whether caused by negligence or otherwise. 

By signing or agreeing to this document (digitally or in writing), you confirm that it is your intention to exempt and relieve Canolfan Beaumaris from all liability for personal injury, property damage, or wrongful death caused by negligence or any other cause. 

 

2. Abuse of Membership 

You fully understand and acknowledge the following measures, any breach of which may result in your membership being suspended or terminated without refund: 

(a) Allowing non-members to gain access to the gym by sharing or lending key fobs, QR codes, or door entry codes. 

(b) Failure to maintain valid payment, including missed, cancelled, or expired membership payments. 

(c) Negligence or non-compliance with the health and safety measures in place. 

(d) Tampering with, obstructing, or disabling CCTV or access systems. 

(e) Abusive, aggressive, or threatening behaviour towards staff, members, or property. 

(f) Theft, damage, or unauthorised removal of any Canolfan Beaumaris property, equipment, or stock. 

(g) Failure to securely close and ensure the locking of the entry door upon entering or exiting the facility. Members must never leave the entry door ajar, propped open, or otherwise unsecured. Any breach of 

this rule will be treated as a serious violation of these Terms and Conditions and may result in immediate suspension or cancellation of membership without refund. 

 

3. Unmanned Hours and Safety Guidelines 

(a) The gym operates from 5.00am every day. During unmanned hours, members train at their own risk and must adhere to all posted safety signage. 

(b) Access during unmanned hours is strictly via personal key fob, QR code, or door entry code. 

(c) Toilet, shower and changing facilities are available; members are expected to respect cleanliness and security at all times. 

(d) Emergency contact numbers are displayed clearly within the facility and must only be used in genuine emergencies. 

(e) CCTV operates continuously for the safety and security of all members. Any attempt to interfere with the system will result in immediate termination of membership and may result in prosecution. 

(f) In the event of a fire, please evacuate the building immediately via the nearest exit and make your way to the front car park. Once safe, dial 999 and await emergency services. Do not re-enter the building until it has been declared safe by the authorities or management. 

(g) In the case of an accident, the first aid box is located outside of the gym entrance. All accidents, however minor, must be reported to management as soon as possible so that details can be recorded in the official accident book. 

 

4. Membership Terms and Payments 

(a) Membership Types: 

• Rolling monthly (recurring direct debit) 

• Weekly pass (upfront card payment) 

• 6 months pass (upfront card payment) 

• Pay-as-you-go options also available 

(b) Contract and Termination: 

• Rolling monthly memberships may be cancelled at any time with a minimum of 30 days’ written notice (email or signed written document accepted). 

• Payments will continue during the notice period. 

• No refunds are issued for unused membership periods or failure to attend. 

• Canolfan Beaumaris reserves the right to terminate any membership immediately if terms are breached. 

(c) Payment Failure: 

• Failure to maintain valid payments may result in access being suspended until the account is brought up to date. 

• Persistent non-payment may result in referral to a debt recovery agency. 

(d) Membership Transfer: 

• Memberships are personal and non-transferable. 

 

5. Inductions and Equipment Use 

(a) All members are offered a gym induction. 

(b) Members who choose not to attend an induction do so at their own risk. 

(c) Canolfan Beaumaris will not accept any liability for injury or damages resulting from improper or unsafe use of equipment. 

(d) If unsure about any equipment, members must seek advice from qualified staff before use. 

 

6. General Gym Rules 

(a) The gym is strictly for members aged 16 and over. 

(b) No bags are permitted on the gym floor. Storage areas are provided for session use only. 

(c) Appropriate gym attire and footwear must be worn at all times. No workwear, sandals, or flip-flops. 

(d) Clean gym shoes must be worn at all times. Members must not wear dirty or outdoor shoes inside the gym. This rule is in place to maintain hygiene and protect gym flooring and equipment. 

(e) The use of alcohol, drugs, or any substance that may impair safe exercise is strictly prohibited. 

(f) All weights and equipment must be returned to their proper place after use. 

(g) Please wipe down all equipment after use using the sanitising spray and blue paper towels. 

(h) Smoking and vaping (including e-cigarettes) are strictly prohibited anywhere on the premises. 

(i) Personal trainers not licensed by Canolfan Beaumaris are not permitted to train members without written permission from the gym’s management. 

(j) Pets are not permitted, except registered assistance dogs. 

(k) Aggressive, anti-social, or abusive behaviour will result in immediate termination of membership. 

(l) Misuse of equipment, including dropping weights, may lead to membership suspension or termination. 

(m) Members must not take photographs or videos on the premises or post material identifying other members without consent. 

 

7. Fitness Class Terms and Conditions 

Classes held in the smaller gallery room will be limited to one class per evening. However, if spaces become available you are welcome to attend. This is to ensure we can provide activities for new participants wishing to join from the community. 

 

8. Property and Security 

(a) Members are solely responsible for their personal belongings while using the facility. 

(b) Canolfan Beaumaris accepts no responsibility for loss, theft, or damage to personal property. 

(c) Lost property will be held for up to three months before being donated or disposed of. 

(d) For the safety and security of all members, the facility’s entry door must remain closed and locked at all times except when entering or exiting. Members are personally responsible for ensuring the door is fully secured behind them. Failure to do so may result in disciplinary action as outlined in Section 2. 

(e) The fire doors are alarmed and must only be opened in the event of an emergency or when authorised by management. Any unauthorised opening of these doors will activate an alarm and will be treated as a serious breach of security, potentially leading to immediate suspension or termination of membership. 

 

8. Contact Information 

Members must inform Canolfan Beaumaris of any changes to contact details, including address, email, or telephone number. Updates can be made via the Clubright app, email, or social media message. 

 

9. Medical and Health Declaration 

(a) All members must complete a Physical Activity Readiness Questionnaire (PAR-Q). 

(b) If the PAR-Q advises consultation with a doctor, members must do so prior to exercise. 

(c) Membership fees remain active and non-refundable while awaiting medical clearance. 

(d) Members are responsible for notifying Canolfan Beaumaris of any changes to their health status, medical conditions, or injuries that may affect their ability to exercise safely. Members must update their PAR-Q accordingly whenever such changes occur. Failure to do so may result in suspension of access until an updated form is completed and reviewed. 

 

10. Cancellation Policy 

• 30 days’ written notice required for membership cancellations. 

• Cancellation requests must be submitted via email, social media message or written letter to management. 

• No refunds for unused membership periods. 

• Any payments due during the 30-day notice period will still be collected. 

• Canolfan Beaumaris reserves the right to terminate a membership immediately for serious breaches of policy or conduct. In such cases, any future payments will be cancelled. 

 

 

 

11. Gym Availability 

The Canolfan reserve the right to close the gym for various reason including 

• Beaumaris Music Festival 

• Theatre events 

• Maintenance of the facilities  

 

 

12. Agreement 

By signing below, registering online, or accessing Canolfan Beaumaris using an access method (key fob/QR/code), you confirm that you: 

• Have read, understood, and agreed to these Terms and Conditions; 

• Accept full responsibility for your own safety while on the premises; and 

• Agree to the waiver and release of liability contained herein.
